DECISIONS OF THE

INTERIOR BOARD OF INDIAN APPEALS

IN MEMORIAM -- JUDGE ANITA VOGT

This website has been brought to you as a public service by former IBIA Administrative Judge Anita Vogt, who believed that it was unconscionable that Tribes and the legal community had no ready access to IBIA decisions after the official website of the Department of the Interior's Office of Hearings and Appeals was disconnected from the internet as the result of a court order. After her retirement from the IBIA, Judge Vogt taught herself everything necessary to develop and maintain this website, and continued it for over three years, even though she never anticipated such an extended need.

Judge Vogt passed away on March 26, 2007, after a short illness brought on by an extremely aggressive form of cancer. Even as she was recovering from surgery and facing the prospect of undergoing chemotherapy, she continued to work on this website, ensuring that the most recent cases sent to her by the IBIA were prepared and posted. She also extracted a promise from her family and friends that they would continue this website until the Office of Hearings and Appeals is able to reconnect to the internet.

If you would like to express condolences to Judge Vogt's family, you may send an email to JudgeAVogt@yahoo.com.

This site contains decisions issued by the Interior Board of Indian Appeals (IBIA) from its inception in 1970 through March 27, 2008. This is an unofficial site and is not associated in any way with the Department of the Interior. The site is offered as a public service and will remain on-line until the official website of the Interior Board of Indian Appeals returns.

If you need a copy of an IBIA decision issued after March 27, 2008, or if you have a question about the Interior Board of Indian Appeals, contact the Board at 801 North Quincy Street, Arlington, Virginia 22203, (703) 235-3816.

The IBIA decisions on this site have been released by the Department of the Interior under the Freedom of Information Act.

The decisions are in PDF format. To read them, you must have the Adobe Acrobat Reader on your computer. If you do not have the reader, you may download it free of charge at the Adobe website.

To find an IBIA decision by name, citation, or date, use the indexes on this site. Links are at the left.

The site also includes surveys of IBIA decisions on three subjects: Land Acquisition (Updated version, April 1, 2004), Probate (August 22, 2000), and Tribal Government (July 13, 1998). These surveys were prepared by Interior Department Field Solicitor Priscilla A. Wilfahrt, who has graciously permitted their inclusion here.

There is no subject index or search engine on this site. However, the site has been indexed by Google and Yahoo, so you can make a subject search using either of these search engines.

Use Google Advanced Search as follows:

1. In the top part of the form, enter the words and/or exact phrases you are looking for. See Google's Advanced Search Tips if you need help in framing your search terms.

2. Under Domain, enter the URL for this site, that is, www.ibiadecisions.com.

3. Press the Google Search button.

You can make the same kind of search using Yahoo Advanced Search.

Both Google and Yahoo give you the option of viewing the decisions in either PDF format or HTML format. In HTML format, Google highlights your search terms and, if you have entered more than one search term, even highlights them in different colors! Yahoo HTML does not include highlights.
